at the new york stock exchange. as we hurry toward the edges of the fiscal cliff, this market holding its breath. but holding up. >> yes, so far. technology one of the few bright spots with apple rebounding after that huge decline we saw yesterday. its worst day in four years. it's got everybody on wall street scratching their heads trying to figure out what the problem is with apple. at any rate, here's where we stands right now. sort of a meandering day for the markets. some economic data out this morning. the market responding to that. then a sideways move after that. the nasdaq benefitting from the rebound in technology yesterday. up 11.5 points on the thatnasda. the s&p is also trading higher. there it is. up 2.5 points on the s&p. >> meanwhile, bullish sentiment at an eight-month high right now. equity allocation is still at the lowest level of the year according to the american association of individual investors survey that was out this weekend. stock in a wait-and-see mode. totally understandable until these fiscal issues are resolved. >> but don't just sit on your hands. there i

the fiscal cliff. nbc's tracie potts joins us live from washington with app update on all of this. tracie, good morning to you. >> reporter: lynn, not quite empty. a lot of lawmakers on a long weekend break. take a look at some of the frustrated constituents they'll face. a protest in baltimore over social security, not the check but the jobs. the people who work in the offices who fear there could be super long lines for taxpayers if, in fact, their jobs are cut in all of this. so where do we stand today? there's a hearing today on capitol hill. the joint economic committee hearing on what can be done for the fiscal cliff. treasury secretary timothy geithner says the administration is willing to go over the cliff, let taxes go up, let these taxes happen if republicans press the idea of no tax increases for the wealthy. the latest we've learned, president obama and house speaker john boehner have spoken by phone. no word on what they discussed or whether there are any meetings planned, but just the fact that they're talking seems to be progress these days here on capitol hill. >> we'll ta

of this "fiscal cliff" drama, they spoke yesterday raising hopes that formal talks will resume on how to to avoid across-the-board spending cuts and tax increases. we have been saying this for weeks. they will kick in if a budget agreement is not reached by year's end. >>> a number of state lawmakers had their cars fixed and you paid for it. lawmakers lost the perk of a free car about a year ago at least 37 of them deciding to buy the cars. that was an option. they have been using them when the state sold them. first they had all the cars repaired and maintained at state expense. $78,000 worth of work. >> as a taxpayer, you know, it's my money going to it so it's frustrating. >> doesn't sound fair. we work really hard for our money. >> we do. but a source in the legislature says the work was worth it. the state got more money when it sold the cars that were not bought by the lawmakers but had the repairs done. they got more money for those cars. so i guess it evens out. >>> same-sex marriage is now legal in the state of washington. dozens of gay and lesbians got in line to pick up marriage licens
